LocateIQ Terms of Use

1. Scope, acceptance, and controlling agreements

These Terms of Use govern an individual user's access to LocateIQ, including its case-management, research, data-provider, analysis, collaboration, reporting, export, and administrative features (the Service). By accessing or using the Service, the user agrees to comply with these Terms in an individual capacity.

The relationship between F3 Intelligence Corp. and the user's organization is governed by any applicable contract, task order, order form, agency addendum, data or security terms, and provider-specific restrictions (collectively, the Organization Agreement). The Organization Agreement controls if it conflicts with these Terms. Nothing in these Terms means that an individual user personally binds a government organization or overrides applicable law, procurement requirements, or negotiated terms.

2. Eligibility and organization approval

Access is limited to named users whose organization, role, and intended use have been approved. A user must provide accurate account and professional information, access the Service only for the organization associated with the account, and use only the projects, cases, sources, products, and functions assigned to that user.

Organization approval does not authorize every search. A government credential, invitation, payment, account, role, or available feature does not by itself establish legal authority or a permissible purpose. Organization administrators must invite only authorized personnel, assign appropriate access, review access periodically, and promptly remove access when it is no longer required.

3. Authorized government and investigative use

Every search, comparison, AI request, review, export, and disclosure must relate to an active, lawful, documented, and approved government or investigative purpose. Where required, the user must provide an accurate case, matter, incident, mission, client, legal-process, or authorization reference and retain supporting authority.

Users must comply with applicable law, constitutional and civil-rights protections, court rules, professional duties, agency policies, records requirements, the Organization Agreement, provider terms, and source-specific restrictions. Access to one source or product action does not authorize access to another source, purpose, jurisdiction, or category of information.

4. Consumer reporting and eligibility decisions

The Service is offered for approved government and investigative support and is not offered as a consumer report under the Fair Credit Reporting Act. Unless a separate written Organization Agreement expressly authorizes a legally reviewed workflow, users must not use Service information to determine eligibility for employment, promotion, retention, housing, consumer credit, personal insurance, public benefits, licensing, personnel suitability, security-clearance adjudication, military accession, or another consumer-reporting or screening decision.

A user must not evade this restriction by describing an eligibility decision as identity verification, fraud prevention, due diligence, or an investigation.

5. Prohibited use

Users may not use the Service to:

• conduct an unlawful, personal, curiosity-driven, retaliatory, discriminatory, political, or otherwise unauthorized search;
• stalk, harass, intimidate, exploit, doxx, threaten, or unlawfully monitor a person, or circumvent protections for victims, witnesses, confidential sources, protected officials, minors, or other protected persons;
• conduct generalized mass surveillance, list building, marketing, or unrelated bulk enrichment;
• treat a name, address, phone, image, device, vehicle, account, similarity indicator, confidence score, inferred relationship, provider return, or AI-generated suggestion as a confirmed identity or fact without appropriate independent verification;
• make a solely automated enforcement, legal, eligibility, biometric, or other consequential decision;
• use facial comparison, biometric processing, or another restricted feature outside an approved purpose, organization, jurisdiction, and environment;
• submit classified information, Controlled Unclassified Information, Criminal Justice Information, national-security-system information, or another specially restricted category unless the Organization Agreement expressly approves that category and environment;
• resell, publish, scrape, bulk-download, redistribute, or build a separate database from Service information except as expressly authorized;
• remove source, provenance, confidentiality, dissemination, or use-restriction labels;
• share credentials, bypass controls, conceal the true purpose of an action, probe security, interfere with the Service, or use automation outside approved limits; or
• submit content or request information that the user is not authorized to possess, process, disclose, or instruct LocateIQ to process.

6. Accounts and security

Each user must use an individual account, protect credentials and authentication factors, use multi-factor authentication when required, and follow applicable device, network, facility, and session-security requirements. Users must promptly report suspected compromise, unauthorized access, mistaken disclosure, or misuse through the support or security channel provided for their organization.

7. Organization content and instructions

As between LocateIQ and the organization, the organization retains its rights in information, documents, images, notes, instructions, and other materials it submits to the Service (Organization Content). The organization authorizes LocateIQ and its approved providers to host, secure, process, transmit, and return Organization Content as necessary to operate and support the Service and perform the Organization Agreement.

The organization and its users are responsible for identifying the authority, purpose, records status, privacy requirements, retention schedule, disclosure restrictions, and other agency requirements governing Organization Content, except where the Organization Agreement or applicable law assigns a responsibility to LocateIQ. Licensed records, public records, provider responses, and third-party content remain subject to separate rights and restrictions.

8. Investigative results and independent verification

The Service may combine Organization Content, licensed records, public records, public-web material, provider responses, analyst work, inferred associations, similarity results, confidence indicators, and automated or AI-assisted outputs. These materials may be incomplete, delayed, inaccurate, duplicated, stale, taken out of context, attributed to the wrong person, or unavailable. A match, lead, candidate, score, confidence label, facial-similarity result, or relationship is not proof.

Qualified personnel must review available provenance, resolve identity ambiguity and material conflicts, consider contradictory information, and independently verify a result before taking enforcement action, making a legal filing, contacting a subject, publicly disclosing information, or making another consequential decision. The Service does not provide legal advice, establish probable cause, replace due process, or grant investigative or enforcement authority.

9. AI-assisted and image-analysis features

AI-assisted features may summarize, extract, compare, prepare proposed text, classify, or recommend information. Image-analysis features may produce similarity indicators. Outputs can be inaccurate, incomplete, biased, or unsupported and must be treated as provisional work product or investigative leads until independently reviewed and verified.

Users may submit information to these features only when the organization, source terms, applicable law, and Service configuration authorize that processing. Users must not send Service information to an unapproved external AI, image-analysis, or other third-party service.

10. Third-party sources and services

Features may rely on licensed-data providers, public-record systems, public-web services, cloud providers, identity systems, mapping tools, address or phone validation services, communications services, and AI or image-analysis providers. Their availability, data, accuracy, permitted purposes, geographic coverage, retention, export, and redisclosure restrictions may differ.

LocateIQ may limit, suspend, correct, replace, or remove access when required by law, a source owner, a provider agreement, a security concern, or a change in authorization. Third-party names, content, and data remain subject to their owners' rights and terms.

11. Records, privacy, exports, and disclosure

Users must protect Organization Content, results, credentials, source restrictions, and nonpublic Service information. Exports and disclosures may be made only to authorized recipients for the approved purpose and must preserve required source, provenance, confidentiality, dissemination, and use-restriction labels.

Agency records, privacy requests, correction requests, disclosure accountings, public-records requests, discovery, preservation, legal holds, and disposition are handled under the Organization Agreement, applicable records schedules, and law. A legal hold may suspend ordinary deletion but does not grant or restore user access.

12. Audit, review, and enforcement

LocateIQ may log and review authentication, access, searches, declared purposes, source use, case actions, exports, administrative changes, usage, billing, security events, and suspected misuse to operate and protect the Service, allocate costs, investigate complaints, enforce restrictions, and meet legal or contractual obligations.

Access may be delayed, restricted, suspended, or terminated while authorization, anomalous activity, a security event, a complaint, a legal requirement, or a provider restriction is reviewed. Users must cooperate with a reasonable and appropriately scoped inquiry.

13. Service, intellectual property, and availability

F3 Intelligence Corp. and its licensors retain their rights in the Service, software, workflows, documentation, and related technology. Users receive only the limited right to use the Service while authorized under the Organization Agreement.

Plans, usage, support, service objectives, and other commercial or procurement terms are governed by the Organization Agreement. Features and third-party sources may evolve, change, or become unavailable. No result, provider charge, confidence score, completion time, or investigative outcome is guaranteed unless the Organization Agreement expressly states otherwise.

14. Disclaimers and allocation of responsibility

Except as expressly stated in the Organization Agreement and to the maximum extent permitted by applicable law, the Service and its third-party data, public records, public-web information, similarity results, inferred relationships, and AI-assisted outputs are provided on an "as available" basis and are not warranted as proof, as error-free, or as suitable for a consequential decision.

The Organization Agreement controls warranties, service commitments, indemnities, limitations of liability, remedies, governing law, disputes, procurement terms, and other risk allocation. Nothing in these Terms waives a right or obligation that cannot lawfully be waived, expands a user's authority, or overrides sovereign-immunity or government-contract requirements.

15. Suspension, termination, and data handling

Access may be suspended or terminated for material breach, loss of organization or user approval, suspected misuse, security risk, legal requirement, or provider restriction, subject to the Organization Agreement and applicable law. Data return, export, retention, deletion, legal holds, audit evidence, and backup disposition follow the Organization Agreement, applicable records schedule, provider restrictions, and law.

16. Changes to these Terms

LocateIQ may update these Terms to reflect changes in the Service, law, security practices, provider requirements, or approved operations. Material changes will be communicated through the Service or an organization-approved channel and may require renewed acceptance. An Organization Agreement may establish a different change or notice process and controls for its scope.
